Based on the preponderance of evidence it was determined that the caregiver did not use good judgement. The caregiver placed a child over the gate connected to the door rather than opening the gate and sitting the child on the opposite side of the gate. This resulted in the child falling.

This standard was evaluated for this investigation. Two children were found unattended in a classroom. The two children let themselves into the classroom from the outdoor play area. The caregiver didn't know that the children were missing until the rest of the class were coming in from outdoor play and the children were found playing in the sink.
