What this site is, and is not
Daycare Index is an information service. It republishes childcare licensing, inspection and violation records published by state government agencies, statistics calculated from those records, information that providers supply about themselves (clearly labelled as theirs), and reviews written by families who use the site. It is operated by an individual.
Daycare Index is not a childcare provider, a licensing or regulatory authority, a referral or placement agency, an employer of anyone who works at a provider, or an agent of any provider. I have no relationship with the providers listed here beyond showing the public record and, where a provider has claimed its listing, the information it chose to add. A listing on this site is not a recommendation, an endorsement, a certification, or a statement that a provider is safe or suitable for your child.
Your decision, and what happens at a provider
Choosing childcare is your decision, and any arrangement you make with a provider is between you and that provider. I am not a party to it. I am not responsible for the care your child receives, for the acts or omissions of any provider or its staff, or for anything that happens at, near, or in connection with a provider, including injury, illness, loss, or harm of any kind. Nothing on this site replaces visiting a provider, asking questions, checking the state's own records, and using your own judgment.
A provider's licence status, hours, ages served, capacity and inspection history can change at any time, and the record shown here reflects what the state had published on the date named on the page. Before you rely on any fact for a decision, confirm it directly with the provider and with the licensing agency for that state.
No ratings, scores or advice
I do not score, grade or certify providers, and I do not assign safety ratings. Where a state assigns a risk or severity classification to a violation, I show that classification and name the state that assigned it. I never assign one myself. An absence of violations is not a safety certification, and the presence of violations is not a judgment about a provider. Inspection frequency, the standards evaluated and the way findings are recorded vary between states and over time.
Lists on this site have a stated order (see the methodology page). Family ratings, where shown, summarise reviews written by users of this site and are their opinions, not mine. Nothing on this site is legal, medical, educational, financial or child-development advice.
Accuracy of the records
The underlying records are produced by government agencies and may be incomplete, delayed, or wrong. I reproduce them without alteration and I do not warrant their accuracy, completeness or timeliness. Each provider page names its source and the date the data was retrieved. Provider-supplied information is the responsibility of the provider that supplied it. The site and everything on it are provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose. If you find an error, tell me through the corrections page and I will check it against the source.
Limitation of liability
To the fullest extent permitted by law, neither I nor anyone who helps operate Daycare Index will be liable to you or to anyone else for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, opportunity, or goodwill, or for any injury, illness, loss or harm to any person, arising out of or connected with your use of the site, your reliance on anything on it, or your dealings with any provider, however caused and under any theory of liability, even if I have been told such damages were possible. To the extent liability cannot be excluded, my total liability for all claims connected with the site is limited to one hundred US dollars. Some jurisdictions do not allow some of these limitations, so some may not apply to you.
Your responsibility to me
You agree to indemnify and hold harmless me, Daycare Index, and anyone who helps operate it from any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of your use of the site, any content you submit (including reviews, corrections and claimed-listing content), your dealings with any provider, or your breach of these terms or of anyone's rights.
Reviews and other content you submit
Reviews are the opinions of the people who wrote them. I moderate reviews before publishing them and remove ones that break the review rules, but I do not verify the events they describe and I do not adopt them as my own statements. By submitting a review, a correction or claimed-listing content you confirm it is truthful, that it is yours to submit, that you have not been paid or promised anything for it, and that anyone identifiable in a photograph you upload has consented. You grant me a non-exclusive, royalty-free licence to display and moderate it. I may edit for format, decline, or remove any submitted content at any time.
Claimed listings
If you claim a listing, you warrant that you are authorised to act for that licensed operation and that anything you submit is accurate and yours to submit. Claimed content appears in a separate, clearly labelled section and can never overwrite a government record. Providers are responsible for keeping their supplied information current.
Acceptable use
- You may read, link to, quote and cite this site freely, with attribution.
- You may not use it to harass, threaten or defame a provider, a member of staff, a family, or anyone named in a record.
- Automated access should be reasonable and identify itself. If you want bulk data, write to me instead of scraping; the underlying facts are public records and I will point you to their source.
- You may not present the data in a way that implies I rated, endorsed or certified a provider, and you may not remove source attributions.
Links to other sites
Provider websites, maps and directions, state agency pages and other outside links are provided for convenience. I do not control them and I am not responsible for their content or for what happens on them.
Availability and changes
I may change, suspend or discontinue any part of the site at any time, and I may update these terms. Material changes will be noted here with a new date; continuing to use the site after a change means you accept it.
Governing law and contact
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Texas. If any part of these terms is found unenforceable, the rest still applies. Questions: [email protected].
